Maintenance Deposits and Service Fees in West Cairo Compounds: Questions for Resale Buyers

When you buy a resale unit in a West Cairo compound, the sticker price is rarely the only number to plan for. Maintenance deposits, club or facility charges and ongoing service fees all affect your total outlay and your monthly budget. The rules differ between developers and even between phases of the same project, so the smartest move is to know what to ask. Here is how maintenance deposits generally work in Egypt, and the questions we suggest every Palm Hills resale buyer puts to the seller and the developer.

What a Maintenance Deposit Is

A maintenance deposit is an amount written into the sale contract of a residential, administrative or commercial unit, usually paid by the buyer to the developer. Its purpose is to fund the upkeep of common areas across the compound. Legal commentary on the subject explains that the amount is meant to be kept in a separate bank account and that, under the Egyptian Civil Code, the arrangement is treated like a deposit: the holder must preserve it and use it only for its stated purpose.

The Owners Association

Egypt’s Building Law, No. 119 of 2008, provides for residents to form an owners’ federation once a set share of units is occupied. The federation can set up companies to manage and maintain the compound, with members’ shares tied to the area of their units. It is funded through membership fees decided by its general assembly, investment income, donations and loans. For a resale buyer this means that who manages the compound, and who holds the funds, may change as the community matures.

Questions to Ask on a Resale

Ask whether the maintenance deposit has already been paid and whether the seller can prove it with a receipt. Ask whether it transfers to you with the unit or must be settled separately, because this is not standardised and we have not seen a rule that applies to every project. Ask the developer or the management company about current monthly or annual service fees, what they cover, and whether any club or facility membership is included or charged on top.

Build It Into Your Budget

Add any unpaid deposit, transfer-related charges and a realistic service-fee allowance to your calculations before you negotiate. Our closing costs guide and financing comparison will help you see the full picture, and the site-visit checklist reminds you to inspect common areas, which are exactly what these fees pay for.

Get It in Writing

Whatever the seller tells you about fees, ask for the developer’s confirmation in writing before you pay a deposit. Verbal assurances are the most common source of unpleasant surprises after handover. This article is general information and not legal advice; confirm details for your unit with the developer and a qualified lawyer.
